Legal Guide for RESIDINCE PERMIT in TURKEY.

According to the Law on Foreigners and International Protection, foreigners whose entry into Turkey is not prohibited and who arrive in accordance with the Passport Law have the right to reside and travel in Turkey. Foreigners who wish to stay longer than the period granted by a visa or visa exemption, or longer than 90 days, must obtain a residence permit in Turkey.

What is a Residence Permit in Turkey.

A residence permit in Turkey is an authorization granted to foreigners to enable them to stay in Turkey. Residence permits are a requirement of international and local laws.

How Long is a Residence Permit in TurkeyValid.

Foreign nationals who wish to stay in Turkey for more than 90 days must obtain a residence permit in Turkey. If a residence permit is not used within six months from the date of issuance, it may be cancelled and become invalid.

Legal regulations regarding residence permits are set forth in the Law on Foreigners and International Protection and Law No. 5683 on the Residence and Travel of Foreigners in Turkey. Except for those exempt from this permit, foreigners must obtain a residence permit to stay in Türkiye beyond the 90 days duration covered by their visa.

Conditions for Obtaining a Residence Permit in Turkey.

As a rule, to gain a residence permit in Turkey, a foreigner must be present in the country and have entered it legally in order to benefit from the rights granted there. Foreigners who are illegally present in Türkiye or whose entry is prohibited cannot obtain a residence permit in Turkey except the asylum procedure.

Applicants must have entered Turkey in accordance with legal regulations. One condition for legal entry is passing through official border gates. Another is presenting a passport or a document equivalent to a passport upon entry and exit. In addition to presenting a passport, foreigners may be asked for a visa if required.

Residence permits vary according to duration and purpose. The law sets specific conditions for each type of permit, which are explained separately below.

Types of Residence Permits in Turkey.

The law regulates six main types of residence permits in Turkey:

  • Short-term residence permit.
  • Family residence permit.
  • Student residence permit.
  • Long-term residence permit.
  • Humanitarian residence permit.
  • Residence permit for victims of human trafficking.

Each type has specific eligibility requirements and conditions for refusal, cancellation, or non-extension.

Short-Term Residence Permit

This is the most common and flexible type of residence permit. It is generally issued for up to two years at a time (with certain exceptions). Eligible applicants include foreigners who:

  • Conduct scientific research
  • Own immovable property in Turkey (must be residential). This is one of the easiest way of obtaining a residence permit in Turkey.
  • Establish commercial conections or bussiness.
  • Participate in in-service training programs.
  • Come under student exchange agreements.
  • Stay for tourism purposes.
  • Receive medical treatment (excluding companions).
  • Must remain due to judicial or administrative decisions
  • Attend Turkish language courses.
  • Participate in education, research, internships, or courses via public institutions.
  • Recently graduated from Turkish higher education institutions.
  • Make investments determined by the government.

Required Documents

  • Application form.
  • Health insurance.
  • Proof of financial means.
  • Passport (original and copy).
  • Biometric photographs.

Grounds for Refusal or Cancellation

The permit may be denied, cancelled, or not extended if, for example:

  • Required documents are not provided.
  • The applicant is banned from entering Turkey.
  • Adequate housing conditions are lacking.
  • Criminal record is not submitted when requested.
  • Address information is not provided.
  • The permit is used for a purpose other than granted.
  • A deportation order or entry ban exists.

Family Residence Permit in Turkey.

Family reunification rights are granted under certain conditions. Family residence permits may be issued to:

  • Foreign spouse
  • Minor foreign children
  • Dependent foreign children

This permit is granted for up to three years at a time and cannot exceed the sponsor’s permit duration.

Student Residence Permit

Issued to foreign students studying in Türkiye, including:

  • Primary and secondary school students without family permits..
  • Associate, undergraduate, graduate, or doctoral students.

Required documents are similar to short-term permits plus proof of student status.

Long-Term Residence Permit in Turkey.

Granted indefinitely to foreigners who have resided legally in Türkiye for at least eight uninterrupted years or who meet criteria set by the Ministry. Certain groups (e.g., refugees, humanitarian permit holders, temporary protection beneficiaries) are not eligible.

Humanitarian Residence Permit

Issued by authorities in exceptional circumstances, including:

  • Best interests of the child
  • Inability to deport despite a deportation decision
  • Ongoing return procedures to a safe third country
  • Extraordinary situations
  • Urgent humanitarian reasons or public order considerations

Residence Permit for Victims of Human Trafficking

Granted to victims or suspected victims of human trafficking to allow recovery and cooperation with authorities. Initially issued for 30 days and may be extended in six-month periods up to a maximum of three years.

Residence Permit for Foreigners Married to Turkish Citizens

Foreign spouses of Turkish citizens fall under the family residence permit category. Eligible relatives include:

  • Foreign spouse
  • Minor foreign children
  • Dependent foreign children

How to Apply for a Residence Permit in Turkey.

Foreigners may apply for a residence permit in Turkey directly or from abroad. Applications may be submitted personally by the applicant or by an authorized representative. At this level it is highly recomended to be represented by a lawyer.

Application via Turkish Consulates Abroad.

As a rule, applications are submitted to Turkish consulates in the country of nationality or legal residence. Consulates forward applications to the Directorate General of Migration Management with their opinions. The authority evaluates the application and informs the consulate of approval or rejection within a maximum of 90 days. Foreigners entering Turkey with residence or work permits issued by consulates must register their address within 20 working days from the date of entry.

Residence Application from Within Turkey.

Applications in Turkey are submitted online through the e-Residence system. This preliminary application allows the applicant to obtain an appointment at the Provincial Directorate of Migration Management. The authority may approve, reject, or cancel the application.
